FACT CHECK: The stretched case against Chuck Hagel
WASHINGTON (AP) ? Republican-leaning groups opposing President Barack Obama's choice of Chuck Hagel to head the Defense Department have let loose a barrage of claims about the former GOP senator.
They say he endorses automatic cuts to the defense budget, that he wants to decimate the nation's nuclear arsenal, that his membership on the board of a major company that had a Pentagon contract is a conflict of interest that he's ignoring.
A look at Hagel's record suggests many of the contentions are overblown.
In statements and attack ads, the groups have sought to undermine Hagel's nomination in the weeks leading up to his confirmation hearing on Thursday before the Senate Armed Services Committee. His opponents face a tough challenge as Democrats have begun to rally around the president's choice, and the party has the majority votes to confirm the former two-term Nebraska senator, barring surprises.
Here's a look at the validity of some of the criticism of Hagel.

THE CLAIM: "We live in a dangerous world. Iran, North Korea, even Russia. But Barack Obama's nominee for secretary of defense wants America to back down. An end to our nuclear program. Devastating defense cuts. A weaker country."? An ad being run by Americans for a Stronger Defense in the home states of five Democratic senators up for re-election next year ? Alaska's Mark Begich, Arkansas' Mark Pryor, Louisiana's Mary Landrieu, Colorado's Mark Udall and North Carolina's Kay Hagan.
THE FACTS: Hagel has not proposed ending the nuclear weapons program, though he has supported deep cuts.
Hagel was co-author of a May 2012 study by the advocacy group Global Zero that called for an 80 percent reduction of U.S. nuclear weapons and elimination of all nuclear-armed intercontinental ballistic missiles.
The group argued that with the Cold War over, the United States needs no more than 900 total nuclear weapons. Currently, the U.S. and Russia have about 5,000 each, either deployed or in reserve. Both countries are on track to reduce the deployed strategic warheads to 1,550 by 2018, the number set in the New START treaty that the Senate ratified in December 2010.
The study said: "These steps could be taken with Russia in unison through reciprocal presidential directives, negotiated in another round of bilateral arms reduction talks or implemented unilaterally." The report was by Hagel, former ambassadors Richard Burt and Thomas Pickering, retired Gen. James Cartwright, a former vice chairman of the Joint Chiefs of Staff, and retired Gen. John J. Sheehan.
An arsenal of 900 nuclear weapons would not be an "end" to the U.S. nuclear program, but Hagel and the organization did raise the possibility of unilateral reductions. In a statement Monday, Burt and others defended Hagel and dismissed suggestions that they were "unilateralists."
The group running this anti-Hagel ad was formed recently and offers little information about itself on its website. Board member Mauricio Claver-Carone also is director of the US Cuba Democracy Advocates in Washington and favors tighter restrictions on the Castro government.

THE CLAIM: "Opposition is growing even more due to his support for sequestration of the military: huge budget cuts that the Joints Chiefs have already warned the Senate Armed Forces Committee would result in a 'hollow force.'" ? A Jan. 22 statement from Move America Forward, a California-based group founded by conservatives in 2004 to show support for U.S. troops.
THE FACTS: The group offered no evidence Hagel supports sequestration, the budget mechanism that will mean automatic, across-the-board spending cuts March 1 if Congress does not act to avert them. The White House says he opposes the mechanism, which came into play after Hagel left the Senate.
To be sure, Hagel has spoken about cutting Pentagon spending. In a 2011 interview with the Financial Times, Hagel said, "the Defense Department, I think in many ways, has been bloated" and "has gotten everything it's wanted the last 10 years and more."
The base defense budget has nearly doubled over 10 years, to about $528 billion this year. That doesn't include the billions spent on the wars in Iraq and Afghanistan.
Obama and congressional Republicans agreed in August 2011 on a deficit-cutting plan that would cut $487 billion from projected defense spending over 10 years. Democrats and Republicans also voted for automatic cuts of $55 billion this year if a special congressional panel can't come up with a sweeping deficit-cutting plan.
Defense Secretary Leon Panetta has warned against the approach of across-the-board cuts, and Hagel has given no sign that he has a different view.

THE CLAIM: "Now Hagel sits on the board of Chevron, which receives hundreds of millions in Pentagon contracts. ... How can Chuck Hagel run the Pentagon with so many ethical questions about his own record?" ? Ad by the American Future Fund, which is running a "Hagel No" campaign. The group describes itself as advocating conservative, free-market ideals.
THE FACTS: It's widely assumed that Hagel will be leaving the Chevron board, a move common for nominees who face the prospect of such ethical conflicts. The Senate Armed Services Committee has some of the most stringent rules for nominees for senior civilian positions in the Defense Department. The panel requires nominees to divest all financial interests in companies doing business with the department. Stepping down from any board would certainly be required.
The committee bases its decisions on the Defense Department list of companies with contracts valued at $25,000 or more. The list is 330 pages long and includes Chevron.

Home's new owners find skull while landscaping

Police on Sunday were questioning the former owner of a home in Santa Ana where human remains were found in a backyard, authorities said.
The man was being questioned by Santa Ana police in connection with the discovery at a home in North Hesperian Street, police said.
A human skull and bones were found Sunday afternoon by residents who bought the home less than a year ago and who were doing landscaping work in the backyard, police said.
The Orange County Coroner's Office confirmed the remains were human and an anthropologist was being called in to further examine them, said Cpl. Anthony Bertagna, a spokesman for the Santa Ana Police Department.
The home was burned in 2006, Bertagna said, and the former owner had lived at the location for more than 20 years.

Longtime neighbor Evy Disner said the home where the remains were found belonged to Larry T. Dominguez. She said the home was burned in an electrical fire in 2006.
Dinser's husband, Renan, rescued Dominguez from the flames in what she described as "pack rat" conditions.
Disner said Dominguez kept to himself but she heard no complaints from neighbors in the tight-knit community.
"He was an extremely nice person, always friendly," Disner said.
She said that Dominguez inherited the home from his father, who she said lived there for a time.
"We don't know if or when his father passed away," Disner said.
Disner said that after the fire Dominguez lost the house due to a lapse in insurance payments. He sold the house to his next-door neighbors, who were the ones doing work on the house on Sunday when they discovered a skeleton, Disner said.

Chris Brown investigated for possible assault
WEST HOLLYWOOD, Calif. (AP) ? Grammy-winning singer Chris Brown is under investigation for an alleged assault in a West Hollywood parking lot, the Los Angeles County Sheriff's Department said early Monday.
Deputies responding to a report of six men fighting Sunday night found the scene clear, but were told by witnesses there had been a brief fight over a parking space.
"The altercation allegedly led to Chris Brown punching the victim," the department said in a statement released early Monday morning.
The "victim" wasn't identified, but the celebrity website TMZ, which first reported the fight outside the Westlake Recording Studio, said it also involved Frank Ocean, one of the top nominees at the Grammy Awards next month.
In a Twitter posting later, Ocean said he "got jumped by (Brown) and a couple guys" and suffered a finger cut.
It wasn't Brown's first problem in the run-up to the Grammys. His attack on singer Rihanna on the eve of the 2009 awards event overshadowed the show.
Last June, he was injured in a brawl with members of hip-hop star Drake's entourage at a New York nightclub.
No arrests were made. Brown was gone by the time deputies arrived but the department said the investigation is ongoing and Brown would be contacted later.
Email messages to Ocean's publicist and Brown's lawyer and representative were not immediately returned. A man answering the phone at the recording studio declined to comment.
Brown, 23, remains on probation for the attack on Rihanna and is due back in court on Feb. 6 to update a judge on his progress. Prosecutors have raised concerns about records showing that Brown has completed his community labor obligations.

In breast cancer metastasis, researchers identify possible drug target
Jan. 27, 2013 ? The spread of breast cancer to distant organs within the body, an event that often leads to death, appears in many cases to involve the loss of a key protein, according to UC San Francisco researchers, whose new discoveries point to possible targets for therapy.
In the January 27, 2013 online edition of Nature Cell Biology, UCSF scientists describe for the first time how the protein, known as GATA3 -- which is abnormal or absent in many cases of human breast cancer -- normally acts downstream in biochemical pathways to prevent the distant spread of cancer, an event called metastasis.
The discovery points to a biochemical control point that simultaneously holds in check several key events required for tumor cells to successfully spread.
"When GATA3 is present, it turns off many genes that are active in metastasis," said Zena Werb, PhD, a UCSF professor of anatomy who led the research. "We now have identified the molecular mechanisms involved."
The key finding of the new study is that GATA3 acts downstream biochemically to activate a molecule -- obscure until now -- called microRNA29b. MicroRNA29b in turn stops protein production from other genes that play vital roles in metastasis.
The absence or loss of GATA3 can free cancerous cells to break free from their defined roles and tethers within a tumor, to move away from the tumor mass, to induce cancer-promoting inflammation, and to stimulate the development of new blood vessels that can help spreading cancerous cells regrow as tumors in new locations.
"People knew that some of these genes were turned on in some cancers, but they did not know they were turned on because GATA3 and microRNA29b were turned off," Werb said. "If you have 20 genes that are becoming less active all at once due to microRNA29b, it could have a profound effect."
Working with mice, the researchers found that restoring microRNA29b to one of the most deadly types of breast cancer stopped metastasis. But the researchers also found that if they knocked out the microRNA29b, tumors spread even in the presence of GATA3, suggesting that microRNA29b can be the driver of metastasis.
In the mouse models of breast cancer studied by Werb's team, GATA3 normally restrains cancerous cells from breaking away from the main tumor and migrating to other organs.
It might be possible, Werb said, to develop drugs that inhibit breast cancer metastasis by re-activating these controls in cancerous cells that have lost the normal protein.
Many researchers who study early stages of cancer focus on abnormal genes and proteins that cause cells to expand their numbers rapidly, a hallmark of cancer.
However, the ability to spread to distant places and to eventually cause lethal complications requires not only cell division and tumor growth, but also changes in how the cancerous cell negotiates with its surroundings. This relationship must be altered to permit cancer to spread, according to earlier research findings by Werb and others.
"Many of the key processes in cancer that GATA3 suppresses take place outside the cell, in the surrounding environment," she said.
GATA3 is a master control for luminal cells, which line the milk-carrying ducts of the breast. In essence, GATA3 dictates the defining characteristics of a normal breast cell, Werb said.
Luminal breast cancers are the most common form of the disease, and the hormones estrogen and progesterone drive their growth. Loss of the normal GATA3 protein as luminal breast cancers evolve is associated with a greater risk of death, Werb said, and occurs in roughly 10 percent of luminal breast cancer cases.
But, along with many other proteins, GATA3 also is absent in "triple negative," breast cancers, which are more often fatal. Triple negative breast cancers, which disproportionately affect black women and younger women, do not depend on the hormones, nor do they require a third growth factor, called HER2.
Triple negative breast cancers, which account for roughly one-in-five breast cancers, have been more difficult to target successfully with newer treatments.
"The targeting we would like to do is to give back microRNA29b specifically to breast tumor cells to prevent metastasis," Werb said.

Women to serve in military combat | WLFI - West Lafayette, Indiana
WEST LAFAYETTE, Ind. (WLFI) - It's one of the biggest changes to the U.S. military in our nation's history.
Soon, for the very first time, women will be able to actively serve in front-line combat.
Thursday, Defense Secretary Leon Panetta, announced he will lift a ban on women serving in combat.
In a news conference he said he believes women have become an integral part of the military's ability to succeed.
Panetta made his announcement with the Joint Chiefs chairman, General Martin Dempsey.
Panetta said not everyone can meet the qualifications to be a combat soldier but said everyone is entitled to the chance.
?
He said the qualifications will not be reduced, and with women playing a broader role, the military will be strengthened.
Local military personnel said they stand behind Panetta's decision to lift the ban.
"One thing in the military that you get used to is adapting to your environment no matter what it is and no matter what the challenges are," Major Paul Heslin with Purdue's ROTC said. "This just happens to be, or could be, a social challenge that command and leadership will provide guidance to the soldiers."
"They've always done the same thing as any other male officer or enlisted soldier," Noah Rausch with Purdue's ROTC program said. "In the past, they haven't been allowed in the combat branch. But in any other situation they've been in combat and they serve right alongside and they still go overseas."
Panetta's order will open 200,000 more jobs to women primarily in the Army and Marines.
The services will have until May to draw up a plan for opening all units to women and until the end of 2015 to actually implement it.

Business Lobbying In 2012 Soared, Buoyed By Fiscal Cliff Crisis
WASHINGTON -- Lobbying expenditures for large pro-business lobbying groups soared in the last quarter of 2012, driven by election-year politics, the lame-duck congressional session's increased legislation, and the fiscal cliff showdown, according to newly released data analyzed by the Center for Public Integrity.
The nonpartisan research group found that approximately half of the 100 biggest-spending lobbying organizations shelled out more money to influence the federal government in the last three months of 2012 than in the previous three months. Among those same 100, about half increased overall spending on lobbying in 2012.
The data contradicts the longstanding pattern of companies and trade groups spending less money on lobbying during election years, when members of Congress are busy campaigning, than in off years, when more legislation typically gets passed.
Leading the pack in annual spending was the U.S. Chamber of Commerce, the nation's largest pro-business advocacy group. In 2012, the chamber's lobbying spending topped $125 million, an 88 percent increase from the previous year. The lobbying figure doesn't include more than $36 million the group spent influencing the 2012 elections ($28 million of which funded attack ads against Democrats).
Another lobbying outfit that set a new record in 2012 was the National Association of Realtors, which spent $41.5 million lobbying Congress and the Obama administration, according to data analyzed by the Center for Responsive Politics. Of that, $15.4 million, or about 35 percent, was spent in the last three months of the year. The real estate group also spent more than $9.5 million on the 2012 elections, including about $6 million to boost Republican candidates.
Other business interests stood out for how much more they spent in the last quarter of 2012 than they did in the period from July to October. This largely reflected debates on Capitol Hill. The Business Roundtable upped lobbying in the fourth quarter by $800,000, to $4.8 million. Financial industry giant JPMorgan Chase spent $8.8 million lobbying last year, and more than $3.3 million was in the fourth quarter.
Despite high spending by major influence groups, less money ended up in the hands of K Street lobbying firms than in the past, according to lobbying disclosure data. The decline in 2012 continues a trend away from firms that had experienced rocketing growth in the past decade.
It's difficult to gauge the effectiveness of lobbying spending in 2012, because Congress and the White House have yet to hammer out key pieces of a broader budget agreement, notably the spending cuts demanded by congressional Republicans. Throughout the fiscal cliff crisis in December, lobbyists for the Chamber of Commerce and the Business Roundtable maintained a visible presence on Capitol Hill, helping to craft Republican positions and to pressure lawmakers.
As for their election spending, groups like the Chamber of Commerce -- which backed Republicans in Senate races -- were on the losing end of the 2012 elections. For the chamber, political spending on losing Senate races topped $20 million.

United CEO cites confidence in Boeing's ability to fix 787
(Reuters) - United Continental Holdings Inc
"History teaches us that all new aircraft types have issues and the 787 is no different," United Continental Chairman and Chief Executive Jeff Smisek said during the carrier's earnings conference call. "We continue to have confidence in the aircraft and in Boeing's ability to fix the issues, just as they have done on every other new aircraft model they've produced."
United, the only U.S. carrier currently operating 787 planes, has six 787s, and Smisek said it expects to take delivery of two additional ones in the second half of this year.

FAA probes pilot who nearly clipped man in stunt
The pilot performing a breathtaking feat in a video posted online in which an aerobatic plane travelling at 200 miles an hour comes within feet of a man on a Texas runway was performing the stunt on an expired waiver, ABC News has learned.
Stunt pilot Jason Newburg advertises as a daredevil for hire, specializing in death-defying aerial ballet at air shows. He posted the clip on YouTube on Monday, in which the wing of his plane tipped dangerously close to the ground as he speeds by, nearly taking out a man on an all-terrain vehicle and the cameraman shooting the stunt. The clip before it was taken down had nearly 150,000 views.
Newburg's waiver to perform aerobatics expired in November, sources told ABC News. And even if it hadn't, pilots are required to ensure the safety of people on the ground.
"Several points along the way this guy could have make mistakes that would have killed himself, and the two people that are filming the action here," ABC News aviation consultant Steve Ganyard said.
Newburg often performs with motorcycle showmen known as the Dallas Stunt Riderz, who choreograph maneuvers beneath his bright green plane. But the FAA is apparently not amused by his adrenalin burst of showmanship, telling ABC News it is investigating the incident.
Efforts by ABC News to reach Newburg have been unsuccessful.
Newburg's company was involved in a helicopter crash in 2008. The National Transportation Safety Board report on that crash says the pilot, who was not named, was not licensed to fly a helicopter, and that he took off with, instead of against the wind, causing a hard landing.

New additions increase number of records in USP food fraud database by 60 percent

Seafood, clouding agents and lemon juice among foods vulnerable to fraud
Rockville, Md., January 23, 2013 Nearly 800 new records of "food fraud" added to the U.S. Pharmacopeial Convention's (USP) Food Fraud Database present new information about foods that are vulnerable to fraudulent manipulation in today's food supply. The first iteration of the database compiled 1,300 records of food fraud published between 1980 and 2010. The update increases the total number of records by 60 percentand consists mostly of newer information published in 2011 and 2012 in both scholarly journals and general media.
Initial analyses of the database by USP food scientists was published in the April 5, 2012, Journal of Food Science. This research revealed that milk, vegetable oils and spices were among the top categories where food fraud occurred as documented in published reports. Analyses of new information by USP scientists show similar trends for 2011 and 2012, and add seafood (fish, shrimp), clouding agents and lemon juice as categories vulnerable to food fraud.
Food fraud is a collective term that encompasses the deliberate substitution, addition, tampering or misrepresentation of food, food ingredients or food packaging, or false or misleading statements made about a product for economic gain. A more specific type of fraud, intentional or economically motivated adulteration of food ingredients, has been defined by USP as the fraudulent addition of nonauthentic substances or removal or replacement of authentic substances without the purchaser's knowledge for economic gain to the seller.
"While food fraud has been around for centuries, with a handful of notorious cases well documented, we suspect that what we know about the topic is just the tip of the iceberg," said Dr. Jeffrey Moore, senior scientific liaison for USP and the database's creator and lead analyst. "The idea behind the database was to shed some light on this largely uncharacterized space by collecting and analyzing the fragmented information in the public domain reported by scholars, regulators and media. Ultimately, we hope the database can be used as a tool by food manufacturers, regulators, scientists and others worldwide to help achieve a safer food supplywhether by providing more complete knowledge of known and potential threats, spurring new research and development of more accurate detection methods for potential adulterants, increasing awareness on the part of consumers, lawmakers and others, or by any other means that makes it more difficult on a practical level for parties to engage in this unscrupulous and harmful activitywhich is both a public health and business threat."
USP is a nonprofit, scientific organization that publishes the Food Chemicals Codex (FCC), an international compendium of standards offering specifications for the identity, quality and purity of food ingredients used worldwide. FCC results from the decision-making of the USP Council of Experts' Food Ingredients Expert Committee (chaired by Dr. Andrew Ebert). USP staff scientists worked with scientific experts from this Expert Committee and others to advance the USP Food Fraud Database.
Fraudulent Food Products and Ingredients
Among the new scholarly records added to the database, the top ingredients represented are olive oil, milk, saffron, honey and coffee (all in the top seven in the analysis of 1980-2010 records), followed by tea, fish, clouding agents (commonly used in fruit juices/beverages to improve their visual appearance and make products look freshly squeezed) and black peppernone of which was in the top 25 for 1980-2010. Among the new media and other reports examined, the most-represented products in the database are milk, fish, turmeric, chili powder and cooking oil (all in the top 12 in 1980-2010), followed by shrimp, lemon juice and maple syrup (none of which was even in the top 25 in 1980-2010). Examples of fraud include:
- Milk, Vegetable Oils and Spices: In three areas of ongoing concern, the database indicates watered-down and urea adulterated fluid milk in India, dilution of milk powder with fillers such as maltodextrin in South America and replacement of milk fat with vegetable oil in South America. In the category of oils, olive oil replaced with other, less-expensive vegetable oils was pervasive, and so-called "gutter oil" (waste oil repurposed as cooking oil) was documented in China. With regard to spices, the database shows examples of the dilution or replacement of spices with less-expensive spices or fillers.
- Seafood: With $80 billion in seafood sold in the U.S. each year and more than 80 percent of fish in the country imported, seafood is big businessand fraud is a significant problem. Examples of seafood fraud documented in the database include sale of the fish escolar, often fraudulently mislabeled as white tuna or butterfish. Escolar is banned in Italy and Japan, and other countries have issued advisories on the trade and consumption of this fish. Escolar has high content of waxy esters that is likely to cause a special form of food poisoning called gempylotoxism or gempylid fish poisoning. Another example of seafood fraud included in the database involves puffer fish, with documented incidents in the U.S. of the fish being mislabeled as monkfish to evade import and other restrictions. Puffer fish has caused tetrodotoxin poisonings in the U.S. and elsewhere. "Seafood is an example where food safety controls are species-specific, making replacement of one fish with another especially troublesome," Moore stated.
- Clouding Agents: Considered the 2011 equivalent to the melamine scandal involving Chinese milk products from a few years ago, numerous database records document the plasticizer Di(2-ethylhexyl) phthalate (DEHP) and other related phthalates as having been fraudulently added as clouding agents in place of the more expensive palm oil or other allowed food ingredients in fruit juices, jams and other products. The scope of this fraud was vast: 877 food products from 315 companies were involved; 206 products were exported to as many as 22 countries; and there were roughly 4,000 potential victims in Taiwan. Safety concerns surrounding DEHP include cancer and the improper reproductive organ development in children. DEHP may be used in food contact materials (e.g., seals, packaging), however the amount allowed to migrate into the food is tightly regulated as to not exceed approximately 1.5 ppm; levels in reported examples of food fraud were found from 2-34 and 8,700 ppm in food and supplement products, respectively. The fraudulent replacement of clouding agents may have been ongoing for years, but as with other food frauds, it is often difficult to detect fraud when no immediate illness occurs. However, as illustrated in this episode, severe health repercussions may still result from consumer consumption of an undetected harmful adulterant over an extended period.

LOS ANGELES (AP) ? Prosecutors who have been stymied for years in their attempts to build a criminal conspiracy case against retired Los Angeles Archdiocese Cardinal Roger Mahony and other church leaders said Tuesday they will review newly released priest files for additional evidence.
Thousands of pages from the internal disciplinary files of 14 priests made public Monday show Mahony and other top aides maneuvered behind the scenes to shield molester priests and provide damage control for the church.
Some of the documents provide the strongest evidence to date that Mahony and another key official worked to protect a priest who revealed in therapy sessions that he had raped an 11-year-old boy and abused up to 17 boys.
The top aide, then-Monsignor Thomas J. Curry, is now an auxiliary bishop for the archdiocese's Santa Barbara region. He did not respond Tuesday to a message seeking comment.
Legal experts, however, said even if the documents contain new evidence, it will be almost impossible to prosecute because of problems with the statute of limitations. It's also unclear whether prosecutors, who received some documents via subpoena years ago, already have seen the files made public Monday.
The time window for prosecuting obstruction of justice is 10 years and for conspiracy, it's three years after the last overt criminal act, said Lawrence Rosenthal, a criminal law professor at Chapman University School of Law.
Much of the material in the files dates to the mid-1980s, when Mahony was handling some of the most troublesome problem priests.
"The problem is, a prosecutor looking at this has to do time travel, basically, and go back to the law as it existed at the time of the offenses," Rosenthal said. "And at the time of the offense, you're going to have significant statute of limitations problems."
Mahony apologized Monday for mistakes he made after taking over the nation's largest archdiocese in 1985. An attorney for the church, J. Michael Hennigan, has denied that there was a cover-up attempt. He didn't return a call Tuesday.
The files of dozens more accused priests are expected to be released in the coming weeks as part of a 2007 settlement agreement with more than 500 alleged victims. A judge recently ruled that the church must turn the files over to attorneys for those people without the names and titles of members of the church hierarchy blacked out after The Associated Press and the Los Angeles Times intervened.
The documents raise the possibility of renewed criminal scrutiny for Mahony and others in the archdiocese hierarchy. Mahony retired in 2011.
Prosecutors in Philadelphia last year secured the conviction of a monsignor who was secretary for clergy after a change in state law gave prosecutors more time to file charges and seek evidence. In Missouri, a judge found a bishop guilty last year of failing to report child abuse to the state, making him the highest-ranking U.S. Roman Catholic official to be convicted of a crime relating to the child sexual abuse scandal.
In Los Angeles, the archdiocese and an attorney representing about 30 individual accused priests has fought for years in court to keep the priests' confidential files sealed, citing the clerics' privacy rights. The church was forced under subpoena to turn over some records to the district attorney during an investigation that began in 2002.
In a 2010 memo, a lead prosecutor in that probe said the documents he had showed "the possibility of criminal culpability" by members of the archdiocese leadership, but a criminal conspiracy case was "more and more remote" because of the passage of time.
Deputy District Attorney William Hodgman said investigators had insufficient evidence to fill in a timeline stretching over 20 years hampered by the statute of limitations. He did not return a call or email seeking comment Tuesday.
The U.S. Attorney's Office convened a grand jury in 2009 to hear evidence, but it yielded no indictments. It was unclear Tuesday if that grand jury was still sitting and a spokesman declined to comment.
